Welcome to Mind3D. By accessing or using the Lucid Engine, you agree to be bound by these Terms of Service.

1. Acceptance of Terms

By creating an account, accessing our platform, or using any Mind3D services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Mind3D provides a Spatial Intelligence Engine that includes:

Neural SDF generation for infinite resolution 3D geometry
4D asset simulation with entropy and decay modeling
Biometric-driven environment modification
Audio-to-architecture generation
Gesture-based interaction systems

The Service is provided "as is" and may be subject to limitations, changes, or discontinuation.

3. User Responsibilities

As a user of the Mind3D Engine, you agree to:

Provide accurate and current information
Maintain the security of your account credentials
Not use the Service for illegal or unauthorized purposes
Not attempt to reverse-engineer or extract neural network architectures
Not generate content that violates applicable laws or regulations
Respect intellectual property rights of others

4. Intellectual Property & Asset Ownership

Platform Ownership: The Mind3D Engine, its neural architectures, algorithms, and underlying technology remain the exclusive property of Nexushubs Software.

Your Assets: You retain ownership of 4D assets, geometry, and content you create using the Service.

Gene Pool & Breeding: When you contribute traits or logic to the gene pool, you grant Mind3D a perpetual, royalty-free license to use and distribute those traits. You may earn royalties based on our breeding program terms.

License Grant: We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or commercial projects.

5. Biometric Data & Health Information

Voluntary Participation: Biometric features (heart rate, EEG, etc.) are optional. You may disable these features at any time.

Not Medical Advice: Mind3D is not a medical device. Biometric data is used solely for environmental personalization and entertainment purposes.

Local Processing: Biometric signals are processed on-device whenever technically feasible.

6. Content Moderation

We reserve the right to moderate or remove content that:

Violates intellectual property rights
Contains hate speech, harassment, or explicit content
Could be used to create harmful or dangerous items
Violates applicable laws or regulations

7. Service Availability & SLA

No Uptime Guarantee: During early access, we do not guarantee uninterrupted service availability.

Beta Features: Many features are experimental and may change without notice.

Data Persistence: While we strive to maintain data integrity, we cannot guarantee complete data preservation during beta.

8. Limitation of Liability

To the fullest extent permitted by law, Mind3D and Nexushubs Software shall not be liable for:

Indirect, incidental, special, or consequential damages
Loss of data, assets, or projects
Service interruptions or outages
Actions taken by automated systems or AI agents

Our total liability shall not exceed the amount you paid for the Service in the past 12 months, or $100 if no payment was made.

9. Termination

By You: You may terminate your account at any time by contacting support or using account settings.

By Us: We may suspend or terminate your access for violation of these Terms, fraudulent activity, or at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue.

10. Governing Law

These Terms are governed by the laws of the jurisdiction in which Nexushubs Software is established. Any disputes shall be resolved through binding arbitration.
